Who needs a BOC-3
Carriers with MC authority
Every for-hire motor carrier with operating authority designates a process agent in each state it operates in or crosses.
Brokers and freight forwarders
Required in each state where you have an office or write contracts.
Carriers changing agents
Switching blanket companies means a new BOC-3 filed by the new one.
What a BOC-3 is
Form BOC-3, the Designation of Process Agents, names a person in each state who can accept court papers on your company’s behalf. A blanket filing covers every state at once.
Why it matters
FMCSA won’t activate your authority until a BOC-3 is on file, and it must be there within 90 days of applying.
Who files it
A blanket company files it electronically with FMCSA. Paper forms are no longer accepted.
How long it lasts
It’s a one-time filing that stays on your record unless you change process agents.
