Texas CDL MVR for employers
Order a commercial MVR for a CDL driver licensed in Texas. The total includes Texas’s $6.50 fee at cost. The driver enters their details and authorizes the report privately, and you don’t need an account to buy.
What a Texas MVR shows
Texas sells driver records by type. Type AR, the certified abstract, contains everything in the driver record. DPS provides Type 3, a list of all crashes and violations, only to the license holder. Source
A Texas Type 2 record shows license status plus moving violations, and crashes where a ticket was issued, for 3 years from the date of offense. Source
The years of history in a report ordered through Evergreen depend on what the state releases for employment checks.
Texas rules employers should know
- Texas repealed its Driver Responsibility Program effective September 1, 2019. DPS no longer assesses points for moving violations, and points assessed before then were removed. Source
- DPS can still suspend the license of a habitual violator: a driver with 4 or more moving-violation convictions in 12 consecutive months, or 7 or more in 24 months. Source
- Texas’s Motor Vehicle Records Disclosure Act (Transportation Code chapter 730) lets an employer, or its agent or insurer, get information about a CDL holder, and lets an employer get an employee’s driving history. Source
- Texas employers of CDL holders tested under federal rules must also report each verified positive drug test, adulterated or substituted specimen, or refusal to DPS within 10 days of receiving the result, on Form MCS-20. Source
When you need a Texas MVR
- Hiring: within 30 days of a driver’s start date, get an MVR covering the past 3 years from every state where the driver held a license or permit in that time. That includes Texas even if your company is based somewhere else. 49 CFR 391.23
- Every 12 months: get an MVR covering at least the past 12 months from each state where the driver held a CDL or permit during that time, and review it. 49 CFR 391.25
- Not sure where else the driver has been licensed? MVR + CDLIS searches the national CDL database for licenses in other states.
Ordering directly from the Texas Department of Public Safety (DPS)
Employers can mail Form DR-1 to DPS, either initialing the permitted-use exception for employers verifying a CDL holder’s information or attaching the driver’s signed consent; without one of them, the record comes back without personal information. Source
Drivers who want a copy of their own record should request it from the Texas Department of Public Safety (DPS). Evergreen sells reports to employers only. dps.texas.gov
Questions
- How much does a Texas MVR cost?
- $15.75 for an MVR only, or $18.75 with a CDLIS search: Evergreen’s $9.25 or $12.25 report price plus Texas’s $6.50 fee at cost.
- How far back does a Texas MVR go?
- A Texas Type 2 record shows license status plus moving violations, and crashes where a ticket was issued, for 3 years from the date of offense. The years of history in a report ordered through Evergreen depend on what the state releases for employment checks.
- Does the driver have to consent?
- Yes. After you pay, the driver gets a private link to enter their details and sign the authorization. The report runs only after the driver authorizes.
- Is a Texas MVR enough for a driver qualification file?
- It covers the Texas part of the record. A driver qualification file also needs records from any other state where the driver held a license in the past 3 years, plus the other documents listed in 49 CFR 391.51. An MVR is not a hiring decision.
